Supreme Court grants Robbins Russell Cert. Petition On Chapter 13 Conversion

On December 12, 2014, the U.S. Supreme Court granted cert. in Harris v. Viegelahn (14-400). The case concerns whether creditors are entitled to funds held by a Chapter 13 bankruptcy trustee when the debtor converts a bankruptcy case to Chapter 7. The petition argued that the Chapter 13 trustee’s services terminate upon conversion, and that funds in the trustee’s possession at that time must be refunded to the debtor if they are not part of the Chapter 7 estate. Robbins Russell attorneys Mark Stancil, Alan Untereiner, and Matthew Madden drafted the petition. Matt will argue the case in the Supreme Court this spring.
