Appellate Litigation

Our lawyers have litigated hundreds of appellate cases in their legal careers. Our lawyers' experience includes presenting 51 arguments in the Supreme Court of the United States (with a record of 40 wins, 9 defeats, and 2 split decisions). Our lawyers have also presented arguments in the United States Courts of Appeals for the District of Columbia, First, Second, Third, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, Tenth, Eleventh, and Federal Circuits. Working with co-counsel admitted in the appropriate jurisdictions, we have also litigated in state appellate courts from Alaska to California to Texas to Michigan to Rhode Island to Virginia, among others, as well as, of course the District of Columbia Court of Appeals.

Our partners Larry Robbins and Roy Englert worked in the Office of the Solicitor General. Our lawyers clerked on the Supreme Court of the United States, federal courts of appeals (the D.C., First, Second, Third, Fourth, Fifth, Sixth, Ninth, Tenth, Eleventh, and Federal Circuits), and federal district courts.

Our appellate clients have included trade associations, major financial institutions, a Big-4 accounting firm, major airlines, prominent hedge funds, police officers or police departments in two cities, as well as a police union, two major automotive manufacturers, a leading energy company, an Internet company, a major telecommunications provider, leading healthcare providers, insurance companies, indenture trustees, a leading retailer, a federal judge, individuals engaged in protest activities, individuals convicted of various white-collar criminal offenses, states and municipalities, an individual ERISA plaintiff, and an antitrust plaintiff engaged in the manufacture of transparent tape. Our representation of national trade associations, including the Chamber of Commerce of the United States of America, includes both party litigation and amicus briefs.

Starting with the 2006 edition of The Best Lawyers in America -- the first edition ever to list appellate lawyers separately -- three of our partners have been listed every year. Three of our partners are listed among Washington's top appellate litigators for business in Chambers USA, America's Leading Lawyers for Business.  Four of our partners are recognized for appellate litigation in Super Lawyers. Our partners speak regularly at Supreme Court press briefings put on by such organizations as the Chamber of Commerce, the Washington Legal Foundation, the American Enterprise Institute, and the Legal Times. Our partners work with litigation clinics at the Georgetown University Law Center and the University of Virginia School of Law.
